Trade Conditions

Secura GmbH is called in the following "registrar". Every individual or company, which is registering a domain name at Secura GmbH, is called "Registered Name Holder". Registrar and Registered Name Holder are concluding this contract.

The contract between Secura GmbH and consumers or resellers about domains and other services is always for defined periods. The first regular contract period is of one,two or several years. It is afterwards automatically prolonged year by year. Consumers or resellers must cancel the contract concerning domains or other services 6 weeks before the end of the contract. Registered Name Holder will receive an invoice for renewal of the contract after the end of the last period. If Registered Name Holder will have not paid this invoice after notices, the domain will be deleted according to ICANN Policies.

ICANN accredited Registrars send notices about the status of domains going to expire according to the new ICANN Policy. Customers of Secura get these notices by e-mails to the Registered Name Holder.

The prices of Domains, authorized by ICANN, are different. The exact prices are published at the special websites for the single domains. The renewal fee is the same as the registration fee. There is no higher renewal fee for late renewals. But there is an additional restore fee for the restore of a deleted domain of 90 US-Dollars for the costs of the restore and the writing of the obligatory restore report.

Registered Name Holder can demand within 30 days after deletion the restore of the domain. The restore fee is 90 US-Dollars/domain. The restore fee is different from the domain renewal fee. It must be paid together with the due domain renewal fee in advance.

If you pay by credit card, your credit card may be billed immediately after purchase.

The Registered Name Holder is not entitled to change registrar within the first 60 days after registration or a domain transfer . The changement of registrar during the contract period does not result in a re-payment of registration fee, even not partially.

The Registered Name Holder shall provide to Registrar accurate and reliable contact details and correct and update them within seven (7) days of any change during the term of the Registered Name registration, including: the full name, postal address, e-mail address, voice telephone number, and fax number if available of the Registered Name Holder; name of authorized person for contact purposes in the case of an Registered Name Holder that is an organization, association, or corporation. The Registered Name Holder shall also provide the names of the primary name server and secondary name server, if the domain shall not use the name servers of Secura GmbH. The Registered Name Holder shall also provide the name, postal address, e-mail adress, voice telephone number and fax number of the technical contact for the Registered Name, if Secura shall not be the Technical contact. The Registered Name Holder shall also provide the name, postal address, e-mail adress, voice telephone number and (where available) fax number of the administrative contact for the Registered Name.

A Registered Name Holder's willful provision of inaccurate or unreliable information, its willful failure to update information provided to Registrar within seven (7) days of any change, or its failure to respond for over fifteen (15) days to inquiries by Registrar concerning the accuracy of contact details associated with the Registered Name Holder's registration shall constitute a material breach of the Registered Name Holder-registrar contract and be a basis for suspension and/or cancellation of the Registered Name registration.

Any Registered Name Holder that intends to license use of a domain name to a third party is nonetheless the Registered Name Holder of record and is responsible for providing its own full contact information and for providing and updating accurate technical and administrative contact information adequate to facilitate timely resolution of any problems that arise in connection with the Registered Name. A Registered Name Holder licensing use of a Registered Name according to this provision shall accept liability for harm caused by wrongful use of the Registered Name, unless it discloses the current contact information provided by the licensee and the identity of the licensee within seven (7) days to a party providing the Registered Name Holder reasonable evidence of actionable harm.

The Registered Name Holder, which supplies Personal data of any third-party individuals (or companies) to the Registrar, is obliged to inform this third-party individual (or company) about the rules of data publishing and processing, which are described in these trade conditions. The Registered Name Holder assures, that he has got the consent of the third party to the Data Processing described in these trade conditions.

Data are only collected for the technical and administrative registration process. Registrar will not sell any data, which is collected during registration. The registered domain name, the IP-addresses of the provider, the names of the first and second name servers, and all contact informations of the administrative contact, billing contact or technical contact will be published in the Whois database, which is accessible worldwide by the public. The only purpose of this publication is the protection of consumer`s rights, by prevention the owners of websites to stay anonym.

Officers of Registrar and Registries like VeriSign, Inc. Global Registries, Neulevel Inc. or Afilias Ltd. and ICANN may have access to the collected data. This is necessary for the technical and administrative registration process or for the administration of the www as a whole.

The Registered Name Holder can rectify the data by sending a signed letter, fax or e-mail (with signed PDF-, TIF- or JPG-File) to the Registrar. A unsigned e-mail is not sufficient to correct data in the WHOIS, except the e-mail is sent as immediate reply to Secura's email with the WDRP Notice (notice about Whois Data Rectification). The Registered Name Holder consents to the Data Processing described in these trade conditions.

Registrar will not process the Personal Data collected from the Registered Name Holder in a way incompatible with the purposes and other limitations about which are explained in these trade conditions.

Secura GmbH permits use of data it provides in response to queries for any lawful purposes except to:
(a) allow, enable, or otherwise support the transmission by e-mail, telephone, or facsimile of mass, unsolicited, commercial advertising or solicitations to entities other than the data recipient's own existing customers; or
(b) enable high volume, automated, electronic processes that send queries or data to the systems of any Registry Operator or ICANN-Accredited registrar, except as reasonably necessary to register domain names or modify existing registrations

Registrar takes reasonable precautions to protect Personal Data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

The Registered Name Holder assures to the best of the Registered Name Holder's knowledge and belief, neither the registration of the SLD name nor the manner in which it is directly or indirectly used infringes the legal rights of a third party. Registrar is not obliged to control, if a domain name infringes trade mark rights.

For the adjudication of disputes concerning or arising from use of the SLD name, the Registered Name Holder shall submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (1) of the Registered Name Holder's domicile and (2) where Registrar is located. The applicable law is German law, even if the Register Domain Holder is not located at Germany.

The Registered Name Holder shall agree that its registration of the Registered Name shall be subject to suspension, cancellation, or transfer pursuant to any Specification or Policy, or pursuant to any registrar or registry procedure not inconsistent with any Specification or Policy, (1) to correct mistakes by Registrar or the Registry Operator in registering the name or (2) for the resolution of disputes concerning the Registered Name.

The UDRP , the Uniform Rapid Suspension and all other policies of ICANN and the conditions of the registries like e.g. EURID, VeriSign, Afilias, Neustar, are automatically part of the trade conditions between Secura and the Registered Name Holder.

The Registered Name Holder is irrevocable obliged to indemnify and hold harmless the Registrar, Registries of domains, like e.g. VeriSign, Inc., Afilias Ltd. or Neulevel Inc., ICANN and its directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of or related to the Registered Name Holder's domain name registration. This obligation of Registered Name Holder survives the termination or expiration of the contract between Secura GmbH and Registered Name Holder.

Registrar expressivly disclaims all liability for loss and/or incidental or consequential damage wether arising from negligence, by contract or any other cause for errors, mistakes or any consequences of domain registration by the Registrar.

Secura and its agents, contractors and employees has not any liability under this agreement or otherwise for any type of consequential, exemplary, special, incidental, indirect or punitive damages, including, but not limited to, lost revenue, lost profits, loss of technology, rights or services, or interruption or loss of use of service or equipment, even if such party has been advised of the possibility of such damages, whether arising under theory of contract, tort (including negligence), strict liability or otherwise. This limitation applies even if Secura has been advised of the possibility of such damage. In any event, the liability of Secura and its agents, contractors and employees to a SLD holder for any reason and upon any cause of action shall be limited to the amount paid by Registered Name Holder for such services and domain registration. The fees for secura's services under this agreement have been and will continue to be based upon this allocation of risk. Registered Name Holder hereby releases Secura and its agents, contractors and employees from any and all obligations, liabilities, and claim in excess of the limitation stated in this section.

"ClientTransferProhibited" status
The ClientTransferProhibited" status is set up by the registrar
-at the demand of the customer
-according to ICANN Policies, e.g. if invoices for the domain of past period(s) are unpaid or e.g. there is a pending case according to UDRP.

Change of Registrant
If existing and future registrants give written notice to Secura GmbH about a consent on change of registrant, the change of Registrant may proceed in two ways:
1. The written notices are sufficient for Secura to act on the customers'behalf as Designated Agent and to realize electronically the change of registrant without any e-mail confirmation of the both parties. Secura must impose a 60-day inter-registrar transfer lock following this kind of Change of Registrant.

2. New and old owner get confirmation e-mails. No change of registrant is realized if the confirmation e-mails are not confirmed by both sides. Secura may allow to opt out of the 60-day inter-registrar transfer lock.

All registrants and resellers declare by registration of domains that they accept the new Transfer Policy of ICANN.

Complaints and Abuse
Secura GmbH provides a high standard of performance in terms of "best practices" and "state of art". Domains are registered, if technically possible, immediately. The registration will be confirmed to the customer via e-mail and / or letter or invoice. At the same time Secura is also committed to the policy formulated by ICANN about the Registrants Rights and Responsibilities . Complaints from customers can refer to this document or to the customer's experience. Customers can complain by e-mail to secura@domainregistry.de or by letter or fax at any time of the execution of orders. Secura GmbH handles complaints immediately or at the latest within eight days.

Secura GmbH accepts, if a customer complaint could not be solved by Secura, the Online Dispute Resolution of the European Commission .

Secura GmbH accepts notifications of abuse by authorities and consumer protection associations. Complainants can contact us by e-mail at abuse@domainregistry.de. Complaints are processed within 24 hours. The receipt and consideration of the complaint does not mean that Secura gives remedy to the complainant. All measures of Secura in abuse cases must move under the existing laws.

Secura is encharged by ICANN to send e-mails to the registrants according to ICANN policies. The registrants agree by registering domains at the control of ICANN to receive these e-mails and to inform Secura about changes of the e-mail address. Registrant cannot opt-out from receiving these e-mails.

Registrants opt-in automatically when registering domains to receive e-mails by Secura about financial, technical, administrative and other subjects concerning domains. Registrants can opt-out by clicking the opt-out link at the e-mail or by sending an e-mail to secura@domainregistry.de. Registants, who opt out, declare, that they do this at their own risk.

Secura provides a state-of-art service, but does not represent to anyone that Secura enjoys access to any Registry System that is superior to that of any other registrar accredited for the registries.

Resellers
Resellers do not display the ICANN or ICANN logo, or otherwise represent themselves as accredited by ICANN, unless they have written permission from ICANN to do so.

Resellers must have in effect an electronic or paper registration agreement with the registrant. Any registration agreement used by reseller shall include all registration agreement provisions by the Registries or ICANN and notices required by the ICANN Registrar Accreditation Agreement and any ICANN Consensus Policies, and shall identify the sponsoring registrar or provide a means for identifying the sponsoring registrar, such as a link to the InterNIC Whois lookup service.

Resellers identify the sponsoring registrar upon inquiry from the customer.

Resellers comply with any ICANN adopted Specification or Policy that establishs a program for accreditation of individuals or entities who provide proxy and privacy registration services (a “Proxy Accreditation Program”). Among other features, the Proxy Accreditation Program may require that:
(i)proxy and privacy registration services may only be provided in respect of domain name registrations by individuals or entities Accredited by ICANN pursuant to such Proxy Accreditation Program; and
(ii) Registrar shall prohibit Resellers from knowingly accepting registrations from any provider of proxy and privacy registration services that is not Accredited by ICANN pursuant the Proxy Accreditation Program. Until such time as the Proxy Accreditation Program is established, Registrar shall require Resellers to comply with the Specification on Privacy and Proxy Registrations of the RRA 2013.

Resellers shall publish on their website(s) and/or provide a link to the Registrants’ Benefits and Responsibilities Specification and shall not take any action inconsistent with the corresponding provisions of this Agreement or applicable law. Link:
Registrants Rights and Benefits

Resellers must be aware, that non-compliance with ICANN Policies may be monitored, documented, published and may be the cause for legal consequences. Legal consequences may be e.g. that consumers could use non-compliance to ICANN Rules as arguements in legal conflicts with reseller. The legal consequences may not be limited to such cases.

Resellers are obliged to to indemnify, defend and hold harmless the Registry Operator and Registry Service Provider and their subcontractors, subsidiaries, affiliates, divisions, shareholders, directors, officers, employees, accountants, attorneys, insurers, agents, predecessors, successors and assigns, from and against any and all claims, demands, damages, losses, costs, expenses, causes of action or other liabilities of any kind, whether known or unknown, including reasonable legal and attorney’s fees and expenses, in any way arising out of, relating to, or otherwise in connection with the Registered Name Holder’s domain name registration. The indemnification obligation survives the termination or expiration of the registration agreement.

All registrants, especially registrants of sensible domains like for example .poker, .lotto, .bet .bingo, .casino, .vegas, .bank and .insurance
- must comply with all applicable laws, including those that relate to privacy, data collection, consumer protection (including in relation to misleading and deceptive conduct), fair lending, debt collection, organic farming, disclosure of data, and financial disclosures.
- who collect and maintain sensitive health and financial data implement reasonable and appropriate security measures commensurate with the offering of those services, as defined by applicable law.
- must provide administrative contact information, which must be kept up-to-date, for the notification of complaints or reports of registration abuse, as well as the contact details of the relevant regulatory, or industry self-regulatory, bodies in their main place of business.
- registering at .poker, .lotto and .bet consent to Afilias'Public Interest Commitments
- registering at .organic and .green consent to Afilias' Public Interest Commitments and special for .organic to Registration Policy and Acceptable Use Policy .
- registerng at .lgbt consent to Acceptable Use Policy

Registrants registering Domains of Donuts and of Rightside consent:
-to provide accurate contact information
-to comply with all applicable rules and laws including those that relate to privacy, data collection, consumer protection, import/export of services and disclosure of data.
-not to use the registered domain for distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and providing (consistent with applicable law and any related procedures) consequences for such activities including suspension of domain names.
-for each Registration to the collection and use of the necessary Registrant’s Personal Data.
-in addition to the other requirements in this Agreement, to the extent permitted under applicable law, to the use, copying, distribution, publication, modification and other processing of Registrant’s Personal Data by the Registry.
-that the Registry is entitled to, at any time, verify (a) the truth, accuracy, and completeness of any information provided by the Registrant to the Registry, whether directly, through any of the Registrars of record or otherwise; and (b) the compliance by the Registrant with the applicable Registry Policies. The Registrar and Registrant shall fully comply and cooperate with the Registry in connection with such verification and furnish all available documentation as the Registry may reasonably require to complete the verification.
-that the Registry reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) or other transactions on registry lock, hold or similar status, that it deems necessary, in its discretion; (a) to protect the integrity and stability of the the Registry TLD registries or the Registry System; (b) to comply with any applicable laws, government rules or requirements, requests of law enforcement, or any dispute resolution process; (c) to avoid any liability, civil or criminal, on the part of the Registry, as well as its affiliates, subsidiaries, officers, directors, and employees; (d) for violations of this Agreement, including, without limitation, any exhibits, attachments, or schedules hereto; or (e) to correct mistakes made by the Registry or any Registrar in connection with a domain name registration. The Registry also reserves the right to place a domain name on registry hold, registry lock, or similar status during resolution of a dispute.
-(within thirty days of demand) to indemnify, defend and hold harmless the Registry Operator (by express reference), the Registry’s service providers, Registrar and their respective affiliates and subsidiaries, as well as each of their respective owners, directors, managers, officers, employees, contractors, service providers and agents from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses (including on appeal), arising out of or relating in any way to the Registrant's domain name registration, including, without limitation, the use, registration, extension, renewal, deletion, and/or transfer thereof and/or the violation of any applicable terms or conditions governing the registration.
-not to not enter into any settlement or compromise of any such indemnifiable claim without Registrar’s prior written consent, which consent shall not be unreasonably withheld and that this indemnification obligation shall survive the termination or expiration of the Registration Agreement for any reason.
Registrants registering Domains of Rightside consent also to the Policies of Rightside.

Registrants registering Domains of Uniregistry consent to:
-acknowledge and agree that Uniregistry reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, as it deems necessary, in its unlimited and sole discretion: (i) to correct mistakes made by Uniregistry or any Registrar in connection with a domain name registration, or (ii) for the non-payment of fees to Uniregistry.
-indemnify, defend and hold harmless Uniregistry and its subcontractors, and its and their directors, officers, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses arising out of or relating to, for any reason whatsoever, the Registered Name Holder's domain name registration.
- that this indemnification obligation survive the termination or expiration of the registration agreement.
- to comply with Uniregistry’s Acceptable Use policies and Terms of Service, as they may be updated from time to time and published on the Uniregistry website specific to the Uniregistry TLD for the Registered Name, and consistent with Uniregistry's Registry Agreement with ICANN.
- that Personal Data about the Registered Name Holder is shared with Uniregistry during the registration process.
- such a collection and use of Personal Data.
- to all ICANN consensus policies applicable to Registered Name Holders, including (i) the Uniform Domain Name Dispute Resolution Policy (“UDRP”), as adopted by the ICANN Board of Directors on August 26, 1999; and (ii) the Inter-Registrar Transfer Policy, as adopted by the ICANN Board of Directors on November 12, 2004; and (iii) such other ICANN consensus policies as ICANN publishes on its website and makes applicable to Uniregistry, Registrar or Registered Names Holders.
- that registered Names allocated to Registered Names Holders during any Uniregistry Sunrise Period are non-transferrable for the first ten (10) years after registration.
- that as a Registered Name Holder, you are prohibited in the use of your Registered Name from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and providing (consistent with applicable law and any related procedures)
- that the consequences for such activities include suspension of your registered domain name.
-in case of registering .sexy domain names:
For the .SEXY top-level domain, the Registered Names Holder shall not permit content unsuitable for viewing by a minor to be viewed from the main or top-level directory of a .SEXY domain name. For purposes of clarity, content viewed at the main or top-level directory of a .SEXY domain name is the content immediately visible if a user navigates to http://example.sexy or http://www.example.sexy. No restrictions apply to the content at any other page or subdirectory addressed by a .SEXY Registered Name

Registrants registering Domains of Google Registry consent to
-(a) acknowledge and agree that Registry Operator reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, as it deems necessary, in its unlimited and sole discretion: (i) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs); (ii) to correct mistakes made by Registry Operator or any registrar in connection with a domain name registration; (iii) to protect the rights and property of the Registry Operator and to avoid any potential or actual liability, civil or criminal, on the part of the Registry Operator as well as its affiliates, subsidiaries, officers, directors, representatives, employees, and stockholders; (iv) to protect the integrity and stability of the Registry System and the operation of the DNS; (v) to comply with all Applicable Laws, government rules or requirements, requests of law enforcement or any applicable dispute resolution process; or (vi) for violation of the terms and conditions set forth in any applicable Registration Agreement;

(b) to the extent permitted by Applicable Law, indemnify, defend and hold harmless Registry Operator, its parent company and subcontractors, and its and their directors, officers, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses arising out of or relating to, for any reason whatsoever, the Registered Name Holder's domain name registration. The Registration Agreement shall further require that this indemnification obligation shall survive the termination or expiration of the Registration Agreement;

(c) the collection, use, distribution, publication and sharing of any Registered Name Holder’s Personal Data by Registry Operator and its designees and agents, in a manner consistent with the purposes specified in any notice provided to Registrars pursuant to Subsection 2.9 of this Agreement; (d) submit to proceedings commenced under, and abide by all decisions made by panels in accordance with, the UDRP , PDDRP and the URS;

(e) acknowledge and agree that all domainnames in the Registry TLD(s )will be subject to a Domain Name Abuse Policy, which is made available at g.co/registryDomainAbuse, (“Domain Name Abuse Policy”), as may be amended from time to time in Registry Operator’s sole discretion, and a Sunrise and Landrush Policy, which is made available at g.co/minnaSunriseLandrush, (“Sunrise and Landrush Policy”), as may be amended from time to time until ten (10) days prior to the beginning of the Sunrise Period in Registry Operator’s sole discretion; (f) provide accurate registration information for the Registered Name (including email address confirmed by return email or other method), and immediately correct and update the registration information for the Registered Name during the registration term for the Registered Name;

(g) comply with the terms and conditions of the Registry Operator’s initial launch of the Registry TLD (including without limitation the Sunrise Period, the Landrush Period, the general registration period) and the Registry Operator’s Sunrise and Landrush Policy, and further acknowledge that Registry Operator has no liability of any kind for any loss or liability resulting from the proceedings and processes relating to the Sunrise Period, Landrush Period or general registration period, including, without limitation (i) the ability or inability of a registrant to obtain a Registered Name during these periods, and (ii) the results of any dispute over a Sunrise Period registration; and

(h) refrain from: Distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to Applicable law. Registrar shall provide (consistent with Applicable law and any related procedures) consequences for such activities including suspension of the domain name.

-comply with:
(a) ICANN standards, policies, procedures, and practices, as may be amended from time to time by ICANN, for which Registry Operator has monitoring responsibility in accordance with the Registry Agreement or other agreement with ICANN;

(b) Terms and Conditions, technical policies and other policies applicable to the Registry Tool Kit or access and use of Registry Operator’s website(s); and

(c) Registry Policies like e.g. the .dev policies , which shall become effective upon thirty (30) days’ notice (unless otherwise set forth herein) by Registry Operator to Registrar.

Registrants registering jetzt-domains, uno-domains and buzz-domains consent to:
-(a) acknowledge and agree that Registry reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, as it deems necessary, in its unlimited and sole discretion: (i) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs), (ii) to correct mistakes made by Registry or any Registrar in connection with a domain name registration, or (iii) for the non-payment of fees to Registry.
- comply with Registry’s Acceptable Use policies and Terms of Service, if any, as they may be instituted or updated from time to time and published on the Registry website specific to the Registry TLD for the Registered Name.
- such collection and use of Personal Data.
- until ICANN adopts an alternative Consensus Policy, Specification and/or Temporary Policy, approved by ICANN, with respect to the resolution of disputes concerning Registered Names, Registrar shall comply with the Uniform Domain Name Dispute Resolution Policy (“UDRP”) identified on ICANN's website (www.icann.org/general/consensus-policies.htm), as may be modified from time to time. Registrar shall also comply with the Uniform Rapid Suspension (“URS”) procedure or its replacement, as well as with any other applicable dispute resolution procedure as required by a Registry Operator for which Registrar is providing Registrar Services.
-the interdiction of distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and providing (consistent with applicable law and any related procedures) -that the consequences for such activities may be legal steps including suspension of the domain name.

Registrants registering domains of Minds+Machines, including .bayern, consent to:
-acknowledge and agree that the Registry reserves the right to deny, cancel, or transfer any registration or transaction, or place any domain name(s) on registry lock, hold, or similar status as it deems necessary, in its unlimited and sole discretion: (1) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs); (2) to correct mistakes made by the Registry or any Registrar in connection with a domain name registration; (3) if required by a URS, UDRP, CRS proceeding; or (4) for the non-payment of fees to the Registry.
-indemnify and hold harmless the Registry and its subcontractors, and its and their employees, directors, officers, representatives, delegees, shareholders, affiliates, agents, successors, and/or assigns from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable legal fees and expenses arising out of or relating to, for any reason whatsoever, the Registrant’s domain name registration. The Registrar’s registration agreement shall further require that this indemnification obligation survive the termination or expiration of the registration agreement

Registrants registering domains of Minds+Machines by the Priority Reservation Program acknowledge:
-that the Program does not guarantee that a Customer will get a second level domainname corresponding to their Reservation, especially if:
-The second level domainname corresponding to the Reservation is registered by a trademark owner during the Sunrise period;
-The second level domain name corresponding to the Reservation is blocked by ICANN or any other authority with the authority to block domain name registrations;
-The second level domain name corresponding to the Reservation is reserved by ICANN or any other party with the authority to reservenames;or
-The second level domain name corresponding to the Reservation is made unavailable for reasons beyond th econtrol of the Registry Participant or TLDH.
As explained at every single website, the demanded fee is not just a reservation fee, but covers also the registration of the first year.

Registrants registering ruhr-domains and onl-domains consents:
-to adhere to and comply with Registry Policies adopted by REGISTRY_OPERATOR in relation to the REGISTRY_OPERATOR TLD.
-that they have read prior to registration the registry's policies and have understood them.
-that they know that inspite of the fact, that the Registry Policies are in English and German, they understand that the German version governs and the English version is provided for convenience only.
-acknowledge and agree that (i) Registrant is fully responsible for the registration and use of the registered Domain Name; and that (ii) Registrant shall indemnify, to the maximum extent permitted by Law, defend and hold harmless REGISTRY_OPERATOR, REGISTRY_OPERATOR's service providers, REGISTRY_OPERATOR shareholders, and REGISTRY_OPERATOR directors, officers and employees and agents from and against any claim, damages, liabilities, costs and expenses (including reasonable lawyer fees) arising out of or relating to Registrant's Domain Name registration and/or use.
-to expressly agree that REGISTRY_OPERATOR and REGISTRY_OPERATOR service providers acting on behalf of REGISTRY_OPERATOR reserve the right to change the status of the relevant Domain Name(s) during the resolution of a dispute, a compliance procedure, upon a request from a competent authority (e.g. put on hold, lock), as well as to deny, modify, cancel, suspend, or transfer any registration that it deems necessary, in its complete discretion, in order to:
A. protect the integrity, security, and stability of the Registry System;
B. comply with all appropriate laws, government rules or requirements, requests of law enforcement or any other relevant authority, or in compliance with any dispute resolution process;
C. avoid any liability of REGISTRY_OPERATOR, its affiliates, shareholders, subsidiaries, officers, directors, and employees;
D. stop or prevent any violations of any terms and conditions of this Agreement;
E. correct mistakes made by REGISTRY_OPERATOR, REGISTRY_OPERATOR service providers or any registrar in relation to a Domain Name registration; and
F. ensure compliance with ICANN and/or REGISTRY_OPERATOR Registry Policies.
-to immediately correct and update the registration information for the registered name during the registration term.
- to adhere and comply with all applicable ICANN Policies and Registry Policies for resolution of disputes concerning Domain Names.
-not to distribute malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting, or otherwise engaging in any activity contrary to any Applicable Laws. Registrar must also provide Registrant with a description of the consequences for such activities, including suspension of the Domain Name
-to agree that if the Registrant is using a proxy, privacy, and/or third-party service to register a Domain Name on behalf of the Applicant, the proxy, privacy, and/or third-party service provider is deemed to be the Registrant and any actions and/or inactions that are in violation of any applicable policies, rules, procedures, terms, conditions, regulations, and Applicable Laws are the responsibility of the Registrant.

Consumers registering Berlin-Domains consent:
-to comply with with Registry Policies adopted by REGISTRY in relation to the Registry’s TLD.
- to acknowledge and agree that (i) Registrant is fully responsible for the registration and use of the registered Domain Name; and that (ii) Registrant shall indemnify, to the maximum extent permitted by Law, defend and hold harmless REGISTRY, REGISTRY’s service providers, REGISTRY shareholders, and REGISTRY directors, officers and employees and agents from and against any claim, damages, liabilities, costs and expenses (including reasonable lawyer fees) arising out of or relating to Registrant’s Domain Name registration and/or use.
-to expressly agree that REGISTRY and REGISTRY service providers acting on behalf of REGISTRY reserve the right to change the status of the relevant Domain Name(s) during the resolution of a dispute, a compliance procedure, upon a request from a competent authority (e.g. put on hold, lock), as well as to deny, modify, cancel, suspend, or transfer any registration that it deems necessary, in its complete discretion, in order to:

-to comply with all applicable ICANN Policies and Registry Policies for resolution of disputes concerning Domain Names.
-not to distribute or support malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting, or otherwise engaging in any activity contrary to any Applicable Laws -to understand that the consequences for such activities, including may be the suspension of the Domain Name.
- that if the Registrant is using a proxy, privacy, and/or third-party service to register a Domain Name on behalf of the Registrant, the proxy, privacy, and/or third-party service provider is deemed to be the Registrant and any actions and/or inactions that are in violation of any applicable policies, rules, procedures, terms, conditions, regulations, and Applicable Laws are the responsibility of the Registrant.
-that the REGISTRY is a third party beneficiary of the Registration Agreement, entitled to enforce its rights vested by the Registration Agreement. The rights in these cases or issues vested in REGISTRY as beneficiary of the Registration Agreement shall survive the termination or expiration dotBERLIN GmbH & Co. KG .BERLIN Registry-Registrar Agreement (RRA).
- that the REGISTRY is entitled at any time, and from time to time, during the Term of this Agreement to verify the accuracy and completeness of any information provided by the Registrar to REGISTRY and to verify the compliance by the Registrar with the provisions of this Agreement and/or the Registry Policies.

Domain owners registering Health-Domains consent to the Health Registration Policy .

Consumers registering Domains of Centralnic consent-
-to comply with all applicable laws.
- to comply with all applicable laws escpecially including those that relate to privacy, data collection, consumer protection (including in relation to misleading and deceptive conduct) and applicable consumer laws in respect of fair lending, debt collection, organic farming (if applicable), disclosure of data and financial regulations.
-not to distribute malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and providing (consistent with applicable law and any related procedures) consequences for such activities including suspension and/or the deletion of the domain name.
-that if a registrant is collecting and maintaining sensitive health and financial data, they must comply with applicable laws on the provision of such services and including security measures applicable to that sector.
-to indemnify, defend and hold harmless RO, CentralNic and their subcontractors, and the directors, officers, employees, affiliates and agents of each of them, from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or relating to the Registrant's domain name registration. The Registration Agreement shall further require that this indemnification obligation survive the termination or expiration of the Registration Agreement.

Consumers registering .saarland Domains consent-
(a) to acknowledge and agree that dotSaarland GmbH reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, as it deems necessary, in its unlimited and sole discretion: (1) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs), (2) to correct mistakes made by dotSaarland GmbH or any registrar in connection with a domain name registration, (3) if required by ICANN policy, court order or other authorities, (4) to avoid any liability, civil or criminal in the part of dotSaarland GmbH, as well as its affiliates, subsidiaries, officers, directors, and employess, (5) to comply with any applicable laws, government rules ot requirements, requests of law enforcement, or any dispute resolution process, or (6) for the non-payment of fees to dotSaarland GmbH;
(b) to indemnify, defend and hold harmless dotSaarland GmbH and its subcontractors, and its and their directors, officers, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses in accordance with the German legal provisions regarding such fees and costs as arising out of or relating to, for any reason whatsoever, the Registered Name Holder's domain name registration. The registration agreement shall further require that this indemnification obligation survive the termination or expiration of the registration agreement;
(c)to agree that any violation of the .SAARLAND registry policies by the Registered Name Holder may result in application of consequences (consistent with applicable law and any related procedures) including suspension or deletion of the domain name; and
(d) to agree that the Registered Name Holder is especially prohibited from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and that any evidence of any such activity by the Registered Name Holder may result in application of consequences (consistent with applicable law and any related procedures) including suspension or deletion of the domain name.

Financial Institutions registering Bank-Domains and Individuals/Organizations registering Insurance-Domains
- sign an electronic or paper Registration Agreement with us in the form of our tradeconditions, specially these trade conditions here concerning .bank and .insurance.

- acknowledge and agree that the Registry Operator reserves the right to deny, cancel or transfer any Registered Name registration or transaction, or place any Registered Name (s) on registry lock, hold or similar status, as it deems necessary, in its unlimited and sole discretion:
(i) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs),
(ii) to correct mistakes made by Registry Operator or any Registrar in connection with a domain name registration, or
(iii) for the non-payment of Fees to Registry Operator. In addition, Registrar shall obtain the consent of each Registered Name Holder in the Registry TLD for such collection and use of Personal Data.

- acknowledge that prohibition for the Registered Name Holder from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and that the consequences (consistent with applicable law and any related procedures) for such activities could be penalties, including suspension of the domain name.

- acknowledge, that until ICANN adopts an alternative Consensus Policy, Specification and/or Temporary Policy, approved by ICANN, with respect to the resolution of disputes concerning Registered Names, Registrar uses the Uniform Domain Name Dispute Resolution Policy ("UDRP") identified on ICANN's website (www.icann.org/general/consensus-policies.htm), as may be modified from time to time. Registrar will also use URS procedure, as well as with any other applicable dispute resolution procedure as required by a Registry Operator for which Registrar is accredited.

- agree, that in the event of any dispute concerning the time of the entry of a Registered Name registration into the Registry System, the timestamp shown in the Registry System records shall control.

-agree, that Proxy /Privacy registrations are prohibited.

-agree to deploy DNSSEC for each domain name that resolves in the DNS.

-agree, that - in case that Registrant should have access to the registration environment- Registrant's access to registration systems must be mutually authenticated via Transport Layer Security and secured with multi-factor authentication.

-agree, that Registrants are required to use encryption practices defined by NIST Special Publication 800 - 57, or its successor, for electronic communication between parties, including but not limited to web access, mail exchange, and file transfer, avoiding the use of unencrypted protocols in order to prevent tampering with messages.

-agree, that Registrants must publish a valid Domain-based Message Authentication, Reporting and Conformance (DMARC) record with a requested mail receiver policy of either quarantine or reject for domains that resolve in the DNS. For domains intended to send email, Registrants must publish at least one of the following email authentication DNS Resource Records:

  • Sender Policy Framework (SPF),
  • Domain Keys Identified Mail (DKIM).
    When used to protect non-email sending domains, Registrants are required to publish a DMARC reject requested mail receiver policy. For clarification purposes, Registrants must publish a valid email authentication record under all circumstances. For example, if the Registrant does not use their domain for sending email then they must publish an appropriate record reflective of that policy. When deploying DMARC, Registrants may temporarily use a “none ” (p=none) during the implementation phase of email capabilities on the affected domain, but must change the policy to either quarantine or reject for ongoing operations. It is recommended that DMARC records specify strict identifier alignment for both SPF and DKIM via the adkim and aspf tags. It is recommended that DMARC records published at an organizational domain level set an appropriate sp: tag.

    -accept, that DNS Resource Records (e.g., CNAME, DNAME, SRV) are prohibited from aliasing to DNS records outside of the secure zone.

    -agree, that Nameserver host names must be in the parent zone.

    -agree, that Transport Layer Security (TLS) must be implemented using trusted protocol versions. Transport Layer Security 1.1 or greater must be used. SSL 2.0 and 3.0 are explicitly prohibited. RFC 5746 must be implemented (prevents a known man - in - the - middle attack). The following cipher suite components (authentication, encryption, message authentication code and key exchange algorithms) are excluded from use within the secure zone: Anon, DES, 3DES, FIPS, GOST 28147 - 89, IDEA, WITH_SEED, MD5, NULL, EXPORT, EXPORT1024 and SRP.

    - agree to and comply with Operator's policies and procedures and security requirements , including but not limited to:

  • Acceptable Use / Anti-Abuse Policy
  • Name Allocation Policy
  • Name Selection Policy
  • Privacy Policy
  • Registrant Eligibility Policy
  • Registrant Eligibility Dispute Resolution Policy
  • Reserved Names Challenge Policy
  • Sunrise Dispute Resolution Policy
  • Whois Access Policy

    - agree, that the communication with the registrar after registration uses multi-factor-authentication, e.g. e-mail with PGP-Key and instructions on business paper as attachment, also encrypted by PGP.

    - agree to indemnify, defend and hold harmless the Registry Operator, Registry Service Provider, Registry Verification Agent, and other contractually obligated vendors, and in each case, their Affiliates, partners, subcontractors, subsidiaries, divisions, shareholders, directors, officers, employees, accountants, attorneys, insurers, agents, predecessors, successors, and assigns, from and against any and all claims, demands, damages, losses, costs, expenses, causes of action, or other liabilities of any kind, whether known or unknown, including reasonable legal and attorney's fees and expenses, in any way arising out of, relating to, or otherwise in connection with, the Registered Name Holder's domain name registration and acknowledge that this indemnification obligation of Registered Name Holder shall survive the termination or expiration of the Registration Agreement.

    - agree to ICANN standards, policies, procedures, and practices for which Registry Operator has monitoring responsibility in accordance with the Registry Agreement or other arrangement with ICANN.

    - consent to Registry Operator’s Operational-Requirements, including those set forth on Registry Operator's website at https://www.ftld.com/resources, https://www.ftld.com/faq-registrar, https://www.ftld.com/faq-dotinsurance and https://www.ftld.com/faq-dotbank. Registrant acknowledges that any additional or updated Registry Operator’s Operational Requirements shall be effective upon publication at these places or at http://www.domainregistry.de/tradeconditions.html.

    - accept all applicable requirements and policies posted on Registry Operator’s website at https://www.ftld.com/policies.

    -accept all Public Interest Commitments (as set forth in Specification 11 to the Registry Agreement, as amended from time-to-time) and community registration policies (as set forth in Specification 12 to the Registry Agreement, as amended from time-to-time).

    - respect all applicable national, state or local law, regulation or court order in relation to its operations and registrations of the Registry TLD.

    - oblige to take all necessary action(s) as directed by Registrar or Registry Operator in relation to compliance actions, directives, or instructions from ICANN, and/or as otherwise directed by Registry Operator in its sole discretion as being reasonably necessary for the provision of Registry Services, and enforcing compliance with Registry Operator's Operational and Security Requirements and Operations Pledge, including monitoring for compliance regarding the Registered Name. - will not provide, and shall not permit an Affiliate or third party to provide, the use of privacy or proxy registration services by the Registered Name Holder in registering or maintaining domain name registrations with the TLD, as provided in Registry Operator’s Security Requirements available at: https://www.ftld.com/security/.

    - are informed, that beside the Standard Bank Domains exist Premium Domains, like e.g. single-characters and certain two-letters-domains, which are more expensive at registration and renewal.

    Consumers registering .info-domains consent

  • to the Afilias General Registry Policies
  • to the use,copying,distribution, publication, modification and other processing of Registered Name Holder's Personal Data by Registry Operator (Afilias)

  • submit not only to proceedings commenced under ICANN's Uniform Domain Name Resolution Policy, but also to the Sunrise Dispute Resolution Policy of Afilias.

    Consumers registering .name-domains consent also

  • to the .name conditions and the Defensive Registrations Conditions.
  • to ICANN standards, policies, procedures, and practices for which Registry Operator has monitoring responsibility in accordance with the Registry Agreement or under any other arrangement with ICANN; and
  • operational standards, policies, procedures, and practices for the Registry TLD established from time to time by Registry Operator in a non-arbitrary manner and applicable to all Registrars, including affiliates of Registry Operator, and consistent with ICANN's standards, policies, procedures, and practices and Registry Operator's Registry Agreement with ICANN. Among Registry Operator's operational standards, policies, procedures, and practices are those set forth in Exhibit E. Additional or revised Registry Operator operational standards, policies, procedures, and practices for the Registry TLD shall be effective upon thirty days notice by Registry Operator to Registrar.

    Registrants registering Madrid-Domains comply with and agree to:
    - Registry Policies adopted by Registry Operator.
    - being fully responsible for the registration and use of the registered domain name; and that (ii) Registrant shall hold harmless Registry Operator, Registry’s service providers, as well as Registry directors, officers and employees and agents from and against any claim, damages, liabilities, costs and expenses arising out of or relating to Registrant’s domain name registration and/or use.
    - that Registry Operator and Registry service providers acting on behalf of Registry reserve the right to change the status of the domain name during the resolution of a dispute or a compliance procedure (e.g. put on hold, lock), as well as to deny, modify, cancel or transfer any registration that it deems necessary, in its sole discretion, in order to: a) protect the integrity, security, and stability of the Registry System; b) comply with all appropriate laws, government rules or requirements, requests of law enforcement or any other relevant authority, or in compliance with any dispute resolution process; c) avoid any liability of Registry Operator, its affiliates, members, subsidiaries, officers, directors, and employees; d) stop or prevent any violations of any terms and conditions of this Agreement; e) correct mistakes made by Registry Operator, Registry service providers or any registrar in relation to a domain name registration; and f) ensure compliance with ICANN and/or Registry Policies.
    - immediately correct and update the registration information for the registered name during the registration term. - adhere and all applicable ICANN or Registry Operator mandated policies and procedures for resolution of disputes concerning domain names registered in the Registry System
    - the prohibition distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting, or otherwise engaging in any activity contrary to any applicable law. Registrar must also provide Registrant with a description of potential consequences for such activities, including suspension of the domain name.

    Professionals registering pro-domains consent:

  • to the Afilias General Registry Policies
  • Represent and Warrant that the data provided in the Registered Name or Defensive Registration application is true, correct, up to date, and complete; and that the registrant will at all times during the term of its registration keep the information provided above up to date;
  • Represent and warrant that the registration satisfies the applicable .pro restrictions at the time of registration;
  • Represent and warrant that the Registered Name registration satisfies the digital security requirements stated in Appendix L of the Registry Agreement;
  • Agree to be subject to the Qualification Challenge Policy and the Uniform Domain Name Dispute Resolution Policy (the "UDRP");
  • Agree not to make any representation to any person or entity that expressly or impliedly conveys that the registration of the Registered Item in any way signifies or indicates that the Registered Item Holder possesses any general or specific professional qualifications, including, but not limited to, professional qualifications in a particular field;
  • Certify that the Registered Item Holder has the authority to enter into the registration agreement;
  • For applications during the Sunrise Period, certify that the registration qualifies for a Sunrise Registration, as set forth in Appendix J of the Registry Agreement.
  • For Intellectual Property Defensive Registrations, including Sunrise Registrations, agree to be subject to the Intellectual Property Challenge Defensive Registration Challenge Policy.
  • Agree to the use, copying, distribution, publication, modification and other processing of Registered Item Holder's Personal Data by Registry Operator and its designees and agents in a manner consistent with the purposes specified pursuant to Subsection 2.6 of this Agreement.
  • Acknowledge that Registry Operator will have no liability of any kind for any loss or liability resulting from the proceedings and processes relating to the Sunrise Period including, without limitation: (i) the ability or inability of any registrant to obtain a Registered Item during these periods, and (ii) the results of any dispute over a Sunrise Registration.
  • Acknowledge that the Registrar reserves the right to reject any application to register a Registered Item for any reason or no reason, including but not limited to if either Registrar or Registry Operator reasonably believes it does not satisfy the conditions for a Registrations (including, the Sunrise Registration Conditions or .pro eligibility requirements). The Registered Item Holder acknowledges having read and understood and agrees to be bound by the terms and conditions of the following documents, as they may be amended from time to time, which are hereby incorporated and made an integral part of this Agreement
  • The Uniform Domain Name Dispute Resolution Policy, available at http://www.icann.org/dndr/udrp/ policy.htm
  • (For registration agreements relating to Intellectual Property Defensive Registrations, including Sunrise Registrations:)The Intellectual Property Defensive Registration Challenge, available at http://www.registrypro.pro/defensive.htm and http://www.icann.org/dndr/prosdrp/policy.htm;
  • The Qualification Challenge Policy and Rules, available at http://www.icann.org/dndr/proqcp/policy.htm and http://www.icann.org/dndr/proqcp/uniform-rules.htm;
  • The .pro TLD restriction requirements, available at http://www.registrypro.pro/qualifications.htm;
  • For registrations of Registered Names, the .pro TLD digital certification requirements, available at http://www.registrypro.pro/certifications.htm; and
  • Procedures for any applicable Verification Toolkit. "The Registered Item Holder represents and warrants that, at all times during the term of Registered Item registration, he, she, or it meets the .pro registration requirements set forth by Registry Operator for the registration of the Registered Item Holder's registration. The Registered Item Holder is required to provide prompt notice to Registrar if it fails to meet such registration requirements. Registrar and/or Registry Operator shall have the right to immediately and without notice to Registered Item Holder, suspend, cancel or modify a Registered Item Holder's registration if, at any time, the Registered Item Holder fails to meet the registration requirements for such domain name or Defensive Registration."

    Consumers and companies registering mobi-domains consent also, that Registered Name Holder shall:

  • Indemnify to the maximum extent permitted by law, defend and hold harmless Registry Operator, and its directors, officers, employees and agents from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or relating to the Registered Name Holder’s domain name registration and or use, and this indemnification obligation survive the termination or expiration of the registration agreement; (3.7)
  • Indemnify, defend and hold harmless Registry Services Provider, its subsidiaries and affiliates, and the directors, officers, employees and agents or each of them, from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or relating to the Registered Name Holder’s domain name registration and or use, and indemnification obligation survive the termination or expiration of the registration agreement; (3.7.1)
  • Acknowledge and agree that notwithstanding anything in this Agreement to the contrary, mTLD Top Level Domain Ltd. (“dotMobi”), the Registry Operator of the .mobi TLD, is and shall be an intended third party beneficiary of this Agreement. As such, the parties to this Agreement acknowledge and agree that the third party beneficiary rights of dotMobi have vested and that dotMobi has relied on its third party beneficiary rights under this Agreement in agreeing to Secura GmbH being a registrar for the .mobi top-level domain. Additionally, the third party beneficiary rights of dotMobi shall survive any termination or expiration of this Agreement. (3.8.3)
    Comply with ICANN requirements, standards, policies, procedures, and practices for which Registry Operator has monitoring responsibility in accordance with the Registry Agreement or other arrangement with ICANN; (3.8.1)
    Comply with operational standards, policies, procedures, and practices for the Registry TLD established from time to time by Registry Operator in a non-arbitrary manner as Registry Policies, applicable to all registrars and/or Registered Name Holders, and consistent with the Registry Agreement shall be effective upon thirty days notice by Registry
    Operator to Registrar; (3.8.2)
  • consent to the Afilias General Registry Policies
  • Consent to the use, copying, distribution, publication, modification and other processing of Registered Name Holder's Personal Data by Registry Operator and its designees and agents in a manner consistent with the purposes specified pursuant to Subsection 2.6 and with relevant mandatory local data protection, laws and privacy; (3.8.4)
    Submit to proceedings commenced under ICANN's Uniform Domain Name Dispute Resolution Policy ("UDRP") ; (3.8.5) Immediately correct and update the registration information for the registered Name during the registration term for the Registered Name; (3.8.6)
  • Acknowledge and agree to be bound by the terms and conditions of the initial launch and general operations of the Registry TLD, including without limitation the Limited Industry Launch, the Sunrise Period, the Land Rush Period, the Sunrise Dispute Resolution Policy, the Premium Name Allocation Process, and the General Registration Period , and further to acknowledge that Registry Operator and the Registry Service Provider has no liability of any kind for any loss or liability resulting from the proceedings and processes relating to the Limited Industry Launch, the Sunrise Period, the Land Rush Period, the Sunrise Dispute Resolution Policy, the Premium Name Allocation Process, and the General Registration Period including, without limitation: (a) the ability or inability of a registrant to obtain a Registered Name during these periods,
  • and (b) the results of any dispute made during the limited industry launch or over a Sunrise Registration. (3.8.7) Acknowledge and agree that the Registry and Registry Services Provider, acting in consent with the Registry, reserves the right to deny, cancel or transfer any registration that it deems necessary, in its discretion (i) to protect the integrity and stability of the registry; (ii) to comply with all applicable laws, government rules or requirements, requests of law enforcement, in compliance with any dispute resolution process; (iii) to avoid any liability, civil or criminal, on the part of the Registry as well as its affiliates, subsidiaries, officers, directors, representatives, employees, and stockholders; (iv) for violations of the terms and conditions herein; or (v) to correct mistakes made by the Registry or any registrar in connection with a domain name registration, and the Registry also reserves the right to freeze a Registered Name during resolution of a dispute. (3.8.8.)
  • Acknowledge and agree that they must comply with the requirements, standards, policies, procedures and practices set forth in the dotMobi Style Guide (www.mtld.mobi) and consent to the monitoring of the website as described in the dotMobi Style Guide monitoring guidelines (www.mtld.mobi) for compliance with the Style Guide. Furthermore, Registrant acknowledges and agrees that this Style Guide is subject to modification by the Registry with any such changes appearing at the previously designated URL, and that Registrant must promptly comply with any such changes in the time allotted. (3.8.9)
  • Acknowledge and agree that Proxy or Proxy Registrations will not be allowed during the Sunrise Period, the Limited Industry Launch and the Premium Name Allocation and Auction Period, and in such an instance will constitute a material breach to this contract. (3.9.1).

    Return Policy:We will judge friendly every request of return, which we have been noticed of a customer within 5 days of receipt of a good or within 5 days after the registration of a domain.
